Qualifying Relationship
Your foreign and U.S. employers must be the same company, a parent, subsidiary, or affiliate. We will document the corporate
relationship structure to USCIS’s standards.

One Year Abroad
You must have worked for the foreign entity for at least one continuous year within the past three years in a managerial or executive capacity, with substantive duties beyond the title.

U.S. Role Must Be Executive or Managerial
The U.S. position must also qualify, meaning you direct the organization, manage staff or essential functions, and have the authority that defines executive or managerial work.

U.S. Company Must Be Established
The U.S. employer must have been doing business for at least one year before filing. We will verify this and advise on timing or other options if your company is newer.

Intent to Continue in the Role
The petition must show your U.S. employer intends to employ you in the qualifying role going forward. We will structure the offer letter and supporting evidence accordingly.

No PERM Required
Unlike most employment green cards, the EB-1C bypasses the PERM labor certification process entirely, saving significant time and administrative burden.
